ELM World automated invoicing system.

1. About Us

These Terms & Conditions (“Terms”) govern the provision of digital services by ELM World Ltd (“we”, “us”, “our”) via the FOSSBilling portal and associated websites.

By creating an account, placing an order, or using any service, you agree to these Terms.

2. Services Provided

We provide digital and infrastructure services, including but not limited to:

  • Web and application hosting
  • Virtual machines and server infrastructure
  • Matrix communication accounts and subscriptions
  • Email and mailbox services
  • Domain-related services
  • Nextcloud storage and collaboration services
  • Customised hosting and infrastructure solutions
  • Private WAN, site-to-site, and inter-branch connectivity services

Services may be prepaid, subscription-based, or custom-quoted.

3. Customised Hosting & Infrastructure

Customised services may include:

  • dedicated or semi-dedicated servers
  • bespoke VM, storage, or network layouts
  • hybrid or private infrastructure
  • integration with customer on-premises systems

Unless explicitly agreed in writing, customised services are provided on a best-effort basis and do not include guaranteed performance metrics or service levels.

4. Private WAN & Connectivity Services

Private WAN and connectivity services may include:

  • site-to-site routing
  • VPN or private routed networks
  • reserved bandwidth tiers
  • secure inter-branch communications

These services:

  • depend on third-party carriers and upstream providers
  • are not guaranteed to be uninterrupted
  • do not replace public internet access unless explicitly stated

We do not guarantee latency, jitter, packet loss, or absolute redundancy unless contractually agreed.

5. Account Responsibility

You must:

  • provide accurate registration information
  • keep credentials secure
  • ensure lawful use of services

You are responsible for all activity under your account.

6. Acceptable Use Policy

You must not use our services for:

  • illegal activity under UK, EU, or applicable international law
  • spam, phishing, malware, botnets, or network abuse
  • copyright infringement
  • harassment, threats, or hate content
  • attempts to bypass security, limits, or monitoring
  • fraud or financial crime

We reserve the right to suspend or terminate services immediately, without refund, where abuse or unlawful use is suspected or confirmed.

7. Matrix & Communication Services

Communication services are provided as infrastructure only.

We:

  • do not proactively monitor content
  • do not endorse user-generated content
  • may take action where legally required or upon abuse reports

You are solely responsible for content transmitted or stored.

8. Email Services

Email services must comply with anti-spam and electronic communications laws.

Bulk or unsolicited email, or abuse complaints, may result in immediate suspension.

9. Hosting, Storage & Data

You are responsible for:

  • data stored on your account
  • maintaining backups unless explicitly included

We do not guarantee data recovery unless explicitly agreed.

10. Domains

Domain services are subject to registry and third-party policies.

We cannot guarantee domain availability or renewal beyond the paid term.

11. Payments, Billing & Invoices

Payments are processed via third-party payment providers, including Stripe.

  • Prices are shown before checkout
  • Subscriptions renew only if explicitly stated
  • Invoices may be generated for record-keeping

Failed payments may result in service suspension or termination.

12. Refund Policy

Due to the nature of digital services:

  • No refunds are provided once a service is provisioned or a billing period has begun
  • except where required by law

Statutory consumer rights are not affected.

13. Suspension & Termination

We may suspend or terminate services if:

  • Terms are violated
  • payments fail
  • abuse or security risks are identified
  • required by law or regulation

Outstanding payment obligations remain due.

14. Service Availability

Services are provided on a best-effort basis.

We are not liable for:

  • maintenance windows
  • upstream provider failures
  • force majeure events

15. Limitation of Liability

To the maximum extent permitted by law:

  • we are not liable for indirect or consequential losses
  • total liability is limited to fees paid for the affected service during the previous billing period

Nothing limits liability for fraud or where prohibited by law.

16. Changes to Terms

We may update these Terms. Continued use of services constitutes acceptance of updated Terms.

17. Governing Law

These Terms are governed by the laws of England and Wales.
